It would be something quite bad if they would do so with Miiverse as well! Probably the only actual thing about "communicating with others" on the Wii U! Already that for the 3DS, it's starting to be quite difficult for communications anyways. It'd be hard for the same thing to happen with Miiverse now, but there's no way of sharing offensive content, through images/pictures, of course. Written content and messages that can be deemed as inappropriate are likely to be deleted right away, since the moderation on Miiverse is heavily enforced.
They probablly didn't since they didn't have the StreetPass feature enabled for Swapnote. Ah, so we now know why. That kind of work was really unacceptable. Good thing Nintendo stopped it, and the two men got arrested.
